
Installing a new photovoltaic system is now part of free construction
With the coming into force of the DL 17/2022 published in G.U. n.50 of 01/03/2022 important news have been introduced to encourage the installation of new photovoltaic systems on buildings.
In fact, from now on, it will be possible to install photovoltaic systems on buildings or structures above ground in any way and to carry out the works functional to the connection to the grid of the aforesaid systems without the need to acquire permits, authorizations or administrative acts (with the exception of the systems that fall in areas or properties referred to in Article 136, paragraph 1, letters b, c, of the “Code of cultural heritage and landscape”, identified pursuant to Articles 138 to 141 of the same Code, and without prejudice to the provisions of Articles 21 and 157 of the Code).
The installation of a photovoltaic system will therefore fall within the ordinary maintenance and also from 14/04/2022 the Legislative Decree 199/21 has provided the possibility to use the single simplified model for the connection of plants up to 50 kWp, but that’s not all, by 02/05/2022 is expected a decree that will extend the possibility to use the single simplified model for the connection of plants up to 200 kWp.
These provisions aim to facilitate, also from the bureaucratic point of view, the exploitation of solar photovoltaic and thermal energy and will certainly give a further boost to the growth of energy production from renewable sources.
